Terms of Service

I understand that Force Free Paws, their owners, staff, partners and volunteers, will not be liable, financially or otherwise, for any injuries to my dog, myself or any property of mine while my dog is participating in services provided by Force Free Paws. I hereby release Force Free Paws of any liability of any kind arising from my dogs participation in any and all services provided by Force Free Paws.

I further understand and agree that any problems with my dog, behavioral, medical or otherwise will be treated as deemed best by staff of Force Free Paws in their sole discretion, and in what they view as the best interest of the animal. I understand that I assume full financial responsibility and all liability for any and all expenses involved in regards to the behavior and health of my dog.

I further understand that I am solely responsible, financially or otherwise, for any injury, harm or damage caused by my dog while my dog is attending any services provided by Force Free Paws. I, individually, and on behalf of my heirs, successors, assigns and personal representatives, hereby agree to hold harmless, to the maximum extent permitted by the applicable law, the Company along with its owners, officers, employees, agents, insurers, heirs, successors and assigns from any and all liability, loss, damage or expense, which arises out of, occurs during, or is any way connected with participation in the activities offered by Force Free Paws.

Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial [or other] Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

I hereby agree to allow Force Free Paws to take photographs or use images of my pet in print form or otherwise for publication and/or promotion.

I understand and acknowledge that Force Free Paws is an ethically bound company that will never put any dog in a situation that could cause injury, physically or mentally, to a living being. We do not use or condone the use of fear, intimidation, pain, or aversive techniques to train an animal. We focus primarily on positive reinforcement and relationship building. I agree to remove any and all aversive devises while working with Force Free Paws. Aversive devices include but are not limited to pinch collars, choke collars, shock collars and/or other electronic collars. Refusal to remove aversive devices to train a dog is a breach of contract may result in a termination of the contract. No refunds will be given after the initial payment.

I further understand that this agreement is the entire agreement between the parties, and each party acknowledges that no representations have been made or relied upon which are not specifically set forth in this Agreement. This Agreement includes by incorporation any Exhibits referenced in this Agreement. This Agreement supersedes any agreements to the contrary made previously.

 

ACCEPTANCE OF TERMS

 

1.1 Force Free Paws: Ethical Dog Training (“We”, “us” or “our”) agree to provide services to you subject to the following Terms of Service (“this Agreement”).

 

1.2 The services we agree to provide are personal to you and non-transferable without our express written consent.

 

1.3 When using our services, you will also be bound by any guidelines or rules applicable to such services, which may be posted on our website as at the date you use our Service. All such guidelines or rules are hereby incorporated by reference into this Agreement. We may also offer other services that are governed by different Terms of Service.

 

1.4 You acknowledge and accept that by using our services you agree to be bound by the terms of this Agreement. You represent that you are of legal age to form a binding contract.

 

PAYMENT OF FEES & REFUNDS

 

4.1 You acknowledge and accept that the serviced you have requested will not proceed until full price of the services is paid prior to commencement. If we do not receive the payment prior to commencement, then your service will automatically be cancelled without notice. It is your responsibility to ensure that you have made a valid booking.

 

4.2 We accept cash, checks, zelle quickpay, venmo, cashapp, paypal, online payments, and credit cards.

 

4.3 If you fail to make the full payment on or before the commencement of the service, your booking may, at our sole discretion, be cancelled.

 

4.4 Should you elect to terminate your service after the commencement of the service due to a change of mind or circumstance, we may, at our sole discretion, agree to provide a substitute service at a different time and/or place.

 

4.5 Should you terminate our services due to a change of mind, you will not be entitled to a refund of any fees paid to us.

 

4.6 In the event of any problem with the providing the service, you must give us an opportunity to provide you with a substitute service within a reasonable time before purporting to terminate the service or demanding a refund.

 

4.7 We agree to provide you a refund (less the administration fee) of any monies paid if or a credit applied to your account prior or during a service, at the discretion of the owner for the following circumstances. You acknowledge and accept that any refund granted by us under this clause is limited to monies paid by you to us and we take no responsibility for any third-party charges (i.e. credit card fees) as a result of either a payment made by you or the refund granted by us.

--The services require cancellation due to unforeseen health implications to your dog, of which was not caused by ill-intent (whether deliberate or not deliberate) from yourself, or family or friends of yourself which resulted in the dogs inability to continue with the services purchased.

-- The services require cancellation due to an unexpected loss of the dog, whether death, rehoming, or should the dog run away.

 

No refunds will be given in the following situation:

-- A refund or credit is requested after the completion of the services that were provided due to unforeseen health implications of yourself, which result in your own inability to continue with the dog or another 3rd party in replacement of yourself with the dog.

– A refund or credit is request after the completion of the service(s) that were provided due to unforeseen health implications to your dog, of which was not caused by ill-intent (whether deliberate or not deliberate) from yourself, or family or friends of yourself which resulted in the dogs inability to continue with yourself, or another 3rd party in replacement of yourself

 

4.10 For Private Training Sessions, sessions must be used withing 12 calendar weeks of payment. If the Service is not used within 12 calendar weeks of payment, the Service and all money paid by you will be forfeited.

 

4.11 In the event you fail to attend a private training session at the time and place booked without providing 24 hours notice of cancellation, you may be charged an administration and a reasonable travel fee to reschedule the session.

 

4.12 Should you wish to reschedule a booking, we ask for 72 hours notice prior to the commencement of the training sessions. Less than 24 hours notice will result in an cancellation fee. We do not charge a few to reschedule, however, 3 reschedules in a row may lead to a cancellation fee. Fees are up to the discretion of the trainer.

A NOTE ABOUT WEATHER - If the temperature feels like less than 30 degrees or more than 90 degrees outdoor sessions will be cancelled and moved indoors. "Feels like" is determined by windchill, not temperature. As the trainer I reserve the right to determine safety for both the animals and the people involved. Training sessions may be cancelled or rescheduled do to rain or snow. No refunds will be given if a session is rescheduled due to weather.
